Child Support

The financial obligations of each parent to your children is an important area of your post-separation discussions. We can help you calculate the support that may be payable, and provide advice on the modification, enforcement or formalisation of any existing arrangement.

What is Child Support?

Child Support refers to the financial obligation each parent has to their children. There is federal legislation which determines the amount of child support payable by one parent to another.

We can assist you in calculating the child support payable based on your respective incomes, the care arrangements for the children and the children's individual needs.

I have a Child Support Assessment

If you have a Child Support Assessment in place that doesn't seem right, or that you believe is not accurate, we can provide you with assistance to dispute the assessment.

We can also provide you with advice and support on the enforcement of a Child Support Assessment if one parent is not complying with their obligations.

Can we agree to different Child Support arrangements?

Yes you can! These arrangements need to be properly formalised to be legally binding and enforceable. This requires both parties obtaining independent legal advice (from separate solicitors).

Known as Binding Child Support Agreements, these documents can include provisions for the payment of periodic child support, school fees, extra curricular activities, medical expenses etc.

Lucas Family Law can assist you to formalise your child support agreement.
